Terms of Service

1. Agreement
These Terms of Service govern your use of this website and your purchase of products from AquaVroom ("we", "us", "our"). By placing an order or using this site, you agree to these Terms. If you do not agree, please do not use the site.

2. Eligibility
You must be able to form a legally binding contract to place an order. By ordering, you confirm that the information you provide is accurate and complete.

3. Products
We make reasonable efforts to display product colours and details accurately. Actual appearance may vary depending on your screen. Product availability may change without notice.

4. Product safety
AquaVroom products are recreational pool floats. They are not lifesaving devices, personal flotation devices, or safety equipment. Adult supervision is required at all times when a child is in or near water. Products are labelled for ages 3+. You agree to follow all instructions and warnings supplied with the product, including inflation instructions and weight or age guidance printed on the packaging.

5. Orders and pricing
All prices are listed in Canadian dollars (CAD) unless stated otherwise. We reserve the right to refuse or cancel any order, including where a product has been listed at an incorrect price or is unavailable. If we cancel an order after payment, we will refund the amount charged.

6. Payment
Payment is processed at checkout through Shopify. By submitting payment information, you confirm you are authorized to use the payment method provided.

7. Shipping, returns and refunds
Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Both form part of these Terms.

8. Acceptable use
You agree not to use this site for any unlawful purpose, to interfere with its operation, or to attempt to gain unauthorized access to any part of it.

9. Intellectual property
All content on this site, including text, images, logos and product photography, is owned by us or used with permission, and may not be copied or reused without our written consent.

10. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental or consequential damages arising from the use of our products or this site. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.

11. Consumer rights
Nothing in these Terms limits any rights you have under applicable consumer protection legislation, including the Consumer Protection Act where it applies to you.

12. Governing law
These Terms are governed by the laws of Québec, Canada, without regard to conflict of law principles.

13. Changes
We may update these Terms at any time. The version published on this page at the time of your order applies to that order.
